(1) Employees within the meaning of this Act are workers and employees, including those employed for their vocational training, regardless of whether they are employed in the company, in the field or with teleworking. Those who work from home and who mainly work for the company are also deemed to be employees. Employees are also civil servants (civil servants), soldiers and civil servants, including those employed for their vocational training who work in companies organized under private law.
(2) Employees within the meaning of this Act do not apply
1.
in operations of a legal person, the members of the body that is appointed to legally represent the legal person;
2.
the partners of a general partnership or the members of another group of persons, insofar as they are appointed by law, statutes or articles of association to represent the group of persons or to manage the company;
3.
People whose employment does not primarily serve their gain, but is primarily determined by motives of a charitable or religious nature;
4.
People whose employment is not primarily for their income and who are primarily employed for their healing, re-acclimatization, moral improvement or upbringing;
5.
the spouse, life partner, relatives and first-degree by-laws who live in community with the employer.
(3) Unless expressly stipulated otherwise, this Act does not apply to executive employees. A manager is someone who is based on the employment contract and position in the company or in the company
1.
is entitled to independently hire and dismiss employees employed in the company or in the company department, or
2.
Has general power of attorney or power of attorney and the power of attorney is also not insignificant in relation to the employer or
3.
regularly performs other tasks that are important for the existence and development of the company or a company and the fulfillment of which requires special experience and knowledge, if he either makes the decisions essentially free of instructions or has a significant influence on them; This can also be the case with specifications, in particular due to legal provisions, plans or guidelines, as well as when working with other senior executives.
Sentences 1 and 2 apply accordingly to the officers and soldiers named in paragraph 1 sentence 3.
(4) In case of doubt, the manager in accordance with Paragraph 3 No. 3 is who
1.
on the occasion of the last election of the works council, the committee of speakers or of members of the supervisory board of the employees or by a final court decision to the executive employees or
2.
belongs to a management level at which senior executives are predominantly represented in the company, or
3.
receives regular annual wages that are customary for senior executives in the company, or,
4.
if there are still doubts about the application of number 3, you will receive a regular annual wage that exceeds three times the reference value according to Section 18 of Book Four of the Social Code
