§ 1. General These terms and conditions apply to all current and future business relationships between Drachenmond Verlag GmbH and the customer.

§ 2 Conclusion of a contract
1. The contract is concluded when the buyer places an order with us via the shop system. We reserve the right to freely decide whether to accept this offer.
2. Orders are deemed to have been accepted if the delivery and invoicing are made to the customer and / or if the order is confirmed to the customer in writing.

§ 3 Place of Performance The place of performance is Hürth

§ 4 delivery
1. The goods will be dispatched as quickly as possible, usually within 2-3 working days.
2. If a title cannot be delivered, the buyer will be informed immediately.

§ 5 terms of payment The goods are shipped against prepayment or direct payment via PayPal. Furthermore, cash payment is possible on collection.

§ 6 shipping costs
1. For private customers within Germany, delivery with a minimum order value of EUR 12.00 is free of charge via DPD, including postage and packaging
2. Bookstores receive book trade discounts and are supplied via our Nova MD delivery system.
3. For orders from abroad, you as the buyer pay a share of postage. Individual deliveries are not possible, the order will be sent in full.
4. In the case of cross-border deliveries, you may have to pay additional taxes (e.g. in the case of an intra-community acquisition) and / or duties (e.g. customs duties), but not to the seller, but to the customs or tax authorities responsible there.
5. All prices quoted are in euros including the applicable statutory value added tax.

§ 7 Warranty / Liability
1. The seller is only liable for intent and gross negligence.
2. As the buyer, you are requested to check the goods for completeness, obvious defects and transport damage immediately upon delivery and to notify the publisher and the forwarding agent of any complaints as soon as possible. Your warranty claims remain unaffected.

§ 8 retention of title
The goods remain the property of Drachenmond Verlag GmbH until they have been paid for in full.

§ 9 data protection
1. The seller is entitled to electronically save and process the data provided by the buyer.
2. The seller uses the data exclusively for business relationships with the buyer. There will be no transfer of personal data to third parties.
3. If it is possible to order a book personally signed and this is requested by the buyer by email or note field, the buyer automatically declares that he or she agrees that the order number and name may be forwarded to the respective authors.

§ 10 right of withdrawal
As a customer, you have the following right of revocation: You can revoke your contractual declaration within two weeks without giving reasons in writing (e.g. letter, fax, email) or by returning the goods. The period begins with receipt of these goods at the earliest. The timely dispatch of the cancellation or the goods is sufficient to meet the cancellation deadline.

The right of withdrawal does not apply to books that have been personally signed at the customer's request.

§ 11 Consequences of Revocation
1. In the case of an effective cancellation, the mutually received services are to be returned. If you cannot return the received service in whole or in part, or if you can only return it in a deteriorated condition, you may have to compensate us for the value.
2. As a buyer, you have to bear the costs of the return if the goods delivered correspond to the goods ordered. In the event of a complaint about defective delivery, the return is free of charge for you.

§ 12 final provisions
1. The law of the Federal Republic of Germany applies. The provisions of the UN sales law do not apply. The relevant language for the conclusion of the contract and the entire contractual relationship is German.
2. If the customer is a merchant or a legal person under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Hürth. The same applies if the customer does not have a general place of jurisdiction in Germany or if their domicile or habitual abode are not known at the time the action is brought.

§ 13 Severability Clause
If individual provisions of the contract are wholly or partially ineffective, the validity of the remaining provisions remains unaffected. In place of the ineffective provisions, the respective statutory regulations apply.

§ 14 
In addition, the statutory provisions of the BGB apply.
