Emigration to Australia (Skilled Migration)

The good news first.

Australia has confirmed the level of planning for Australian emigrants with the adoption of the Federal Budget 2021-2022:

  • Approx. 160,000 places for emigrants from Australia are planned for the period July 2021 to June 2022.
  • 80,000 places are reserved for qualified emigrants in the Skilled Migration Stream (e.g. vocational training or studies) and employer-sponsored visa classes. The range of Australian business visa and investor visa classes should also be mentioned here.

Corresponding Australian visa applications for emigrants (i.e. work visas and visas for immigrants) are still processed and issued by the Department of Home Affairs in Australia. Entry is therefore basically also possible, taking into account the applicable Covid requirements of the airlines (e.g. hotel quarantine).

 

Working in Australia (Work Visa)

Australian work visas are processed and issued expedited by the Department of Home Affairs. The visa holder is allowed to work in Australia. These work visas have in common that an Australian employer supports or sponsors the visa application.

Visa holders do not have to apply for an exemption from the Corona travel restrictions before starting their trip if the job description is on the Priority Migration Skilled Occupation List (PMSOL):

Australian citizens (!) Are currently allowed to leave Australia on application and usually only for work purposes.

There is a general ban on all Australian citizens from leaving Australia for the purpose of vacation travel - unless they have dual citizenship.

Visitors and tourists are currently subject to an entry ban. The Department of Home Affairs does not currently process applications from tourists and vacationers, as well as visa applications of the following classes:

Summary

Even if the current regulations appear confusing, we believe there are a simple "rule of thumb".

Visa Australia: The Australian Minister for Immigration has announced the new Priority Migration Skilled Occupation List (PMSOL), which consists of 17 occupations and aims to help restore and recover Australia's job market and economy after CoViD-19.

The Priority Skilled Occupation List (PMSOL) enables foreign skilled workers to apply for a visa and enter Australia. Visa holders in PMSOL professions sponsored by a company in Australia are no longer required to apply for a travel restriction waiver prior to travel. However, upon arrival they would be subject to a rigorous 14-day quarantine at their own expense. Labor market tests (LMT) would also still be required to support a nomination application.

Which visa for Australia in times of Corona?

Like so many other states, the Australian government introduced international travel restrictions in March 2020 due to CoViD-19. All travel to Australia by holders of temporary visas (e.g. business visa, student visa, holiday visa, tourist visa and other visitors) has been suspended.

 

  • July to December 2020: It is assumed that only Australian citizens and permanent visa holders, New Zealand citizens and a small number of international students can travel to Australia.

  • January to June 2021: The travel ban could be lifted (however, a two-week quarantine period may be required when entering Australia). It is assumed that international travel will remain at a low level through the end of the June quarter of 2021.

The Australian government has announced plans to adjust student visa regulations to encourage international student demand to study in Australia in the wake of the COVID-19 pandemic. The published plans contain 5 changes to ensure that international students who require a visa are not disadvantaged by the Corona crisis:

  • Resumption of application processing and decision-making from outside Australiaeb student visa applications.
  • Extension of response deadlines to provide English test results where COVID-19 has disrupted test availability.
  • Graduates who held a student visa can apply Temporary Graduate (subclass 485) visa apply in the post-study work stream outside of Australia.
  • Studies and courses that currently have to be completed online outside Australia due to COVID-19 can count towards the Australian study time requirement for a post-study work visa after graduation.

What is a DAMA?

Emigration to Australia with new visa options: As of November 16, 2019, the introduction of two new visa options will lead to a realignment of the Australian immigration and visa program:

  1. the Skilled Work Regional (Provisional) Visa (subclass 491) - funded by one of the Australian states / territories orby a family member living in the respective region and
  1. the Skilled Employer Sponsored Regional (Provisional) Visa (subclass 494) - based on a job offer.

Applicants for both visa categories should not be older than 44 years and have adequate knowledge of English as well as a successful professional recognition procedure in one of the professions on the respective extensive professional list. The necessary points test is defused.

Both visas initially grant a five-year work and residence permit throughout Australia, with the exception of the metropolitan areas of Sydney, Melbourne, Perth, Brisbane and Gold Coast.

After three years the possibility exists Permanent Residence (Skilled Regional) Visa (subclass 191) to apply, which will ultimately allow free choice of residence throughout Australia (including the metropolitan areas of Sydney, Melbourne, Perth, Brisbane and Gold Coast).

The currently still existing visa options subclass 489 (temporary) and 187 (permanent) will no longer apply as of November 16, 2019.

Following the success of the Northern Territory DAMA, South Australia and Western Australia signed five-year Designated Area Migration Agreements (DAMA) with the Australian government to attract skilled workers to regions where Australian labor is unavailable, helping to fill critical employment gaps:

The regional South Australian DAMA

Up to 750 people per year in 114 professions (including agriculture, forestry, hospitality, tourism, healthcare and construction) can be funded under the five-year contract.

The Adelaid DAMA (Agreement to Promote Technology and Innovation in Adelaide City)

Up to 300 people per year can be funded, spanning 60 professions including agriculture, forestry, hospitality, tourism, health and construction.

The Kalgoorlie Boulder DAMA

This agreement covers 73 professions and will allow up to 500 people per year to benefit from the five-year agreement in the following areas: mining, engineering, construction, childcare and health.

Emigrants on their way to Australia are currently looking forward to the awakening of the DAMAs, which will lower the criteria for skills, language and income - that will make emigration much easier. Due to the continuing shortage of skilled workers, low-skilled foreign workers are also targeted.

According to the new population plan and as part of an initiative by the Australian government, a new way has been opened for visa applicants to move permanently to Australia under the Designated Area Migration Agreement (DAMA). The initiative enables employers in the relevant regions to sponsor employees on Temporary Skill Shortages (sc 482) or Employer Nomination Scheme (sc 186) visas; Visa applicants are expected to commit to living in the DAMA region for at least three to four years.

DAMAs are designed to give Australian states / territories and regions the flexibility to address skills and labor shortages by attracting highly and lower-skilled foreign workers to fill employment gaps in regional areas.

DAMA‘s have previously been introduced for the entire Northern Territory and now also for the Great South Coast region of Victoria, lowering the criteria for skills, language and income.

The Northern Territory DAMA, for example, gives applicants under the age of 50 who have adequate English language skills (e.g. IELTS test with an overall score of 5.0 and at least 4.5 for speaking and listening) the opportunity to study in the Northern Territory employers, positions and also change jobs.

A large number of other regions across Australia are currently considering adopting DAMAs.

On November 28, 2018, the Australian government announced the introduction of a new, temporary visa option for parents and grandparents of Australian citizens or permanent visa holders. This new parent visa is intended to allow an uninterrupted stay in Australia for up to five years. The Australian citizen / permanent visa holder has to act as a formal sponsor for the parents or grandparents and assume full financial responsibility for all costs arising from any medical care required. This includes all costs incurred by the visa holder in Australia, e.g. for hospital and / or emergency treatment, care for the elderly, etc.

The relevant application process is divided into two stages: first, the sponsorship application from the Australian child / grandson (sponsor). Once the sponsorship application has been approved, the actual visa application can follow.

David Coleman (Minister for Immigration and Multicultural Affairs) said the new visa will ensure family reunification for many expats across Australia. At the same time, however, the Australian taxpayer is protected by strict guidelines that ensure that health costs incurred by all parental visa holders, including hospital, emergency and elderly care, do not have to be covered by the Australian taxpayer.

The new parent visa is due to come into force in the first half of 2019.

The Australian visa for qualified emigrants was granted a total of 162,417 indefinitely times in the past financial year (07/2017 to 06/2018); including 111,099 times as a professional visa and 51,085 in the Family Stream as a family visa. During the same period, 80,562 permanent visa holders received Australian citizenship.

According to figures from the Department of Home Affairs (DHA) and the Australian Bureau of Statistics (ABS), the majority of incoming emigrants have settled in Australia's two largest cities, Sydney and Melbourne. Sydney reached 5.1 million inhabitants (with a growth rate of 2%) in June 2017, while Melbourne had 4.9 million inhabitants (with a growth rate of 2.7%). Sydney, Melbourne and Brisbane together accounted for over 70 percent of the population growth in Australia in 2016-17. On the other hand, Darwin, Adelaide and Perth had growth rates of only up to 1%.

As a result of the current rate of population growth, Australia is growing by a city the size of Canberra every year and by a city the size of Adelaide every 3.5 years. The growth is mainly due to the net immigration from overseas (approx. 60% of the population growth of the last ten years). The remaining growth was due to more children being born and residents living longer.

Along with the growth of Australia and the metropolises of Sydney and Melbourne, visa approvals for skilled workers (e.g. in the visa subclasses 189/190) have risen continuously in recent years, while the visa approvals for the Australian regions (visa subclass 489) have risen from 20,510 in 2012-13 fell by almost 50% to 10,198 in 2016-17.

Aside from the sc489 visa, there are currently several other visa categories available to expatriates and employers to fill much-needed positions and fill in immigration deficits in regional and rural Australia. For the current 07/2018 - 06/2019 financial year, the planning level was repeatedly set at 190,000 permanent, unlimited visas.

Prime Minister Scott Morrison has now confirmed that the Australian government is planning a demand-driven, new temporary visa for skilled and regional workers to support the Australian regions.

On November 5, 2018, the Minister for Immigration, Citizenship and Multicultural Affairs announced changes to the Working Holiday Visa programs (WHM); aiming to support regional and rural communities in Australia. These changes apply to visa subclasses 417 and 462.

The changes include:

  • Extension of the labor rights period during which the visa holders can stay with the same agricultural employer (in the plant cultivation and animal breeding business): from 6 to 12 months. Plant and animal breeding operations include most of the agricultural work, e.g.

    • Harvesting and / or packaging of fruits and vegetables
    • Pruning / trimming of vines and trees
    • general maintenance work
    • Cultivation or breeding of plants, mushrooms or their products / parts
    • immediate processing of plant products
    • Keeping animals for the purpose of sale (the animals or animal products)
    • immediate processing of animal products
    • Manufacture of dairy products from raw material.
  • Expanding the number of regional areas where subclass 462 visa holders can work in agriculture (plant growing and animal husbandry) to qualify for a second year in Australia. Previously, this option was limited to parts of the Northern Territory. What is new is that regional areas in New South Wales, Queensland, Victoria and Western Australia as well as the entire Northern Territory, South Australia and Tasmania are now eligible. Exact lists of the postcodes concerned will be published shortly on the department's website.

  • The option of a third year for subclass 417 visas and subclass 462 visas, or visa holders who will work in a certain regional area for at least 6 months (during their second visa year) from July 2019. Participation in the program for the second year is voluntary. Holders of a subclass 462 visa must complete a specified three-month (88 calendar days) job in advance of applying for a second visa.

  • Increased annual caps for a number of countries participating in the 462 visa program. (including Austria, Lucerne, Spain, Portugal, Slovenia, Slovakia, Poland, China and USA)

  • There are also plans to increase the eligible age to 35 for 417 visa applicants from Canada and Ireland.

2017 was an important year for Sydney Migration International. We are starting up as an innovative emigration advice center in order to keep getting a little better. The award is a motivation for us to continue on the path we have chosen. We feel honored and are incredibly grateful for the award.
